ABIP Inspector

REQUEST FOR PROPOSAL FOR ABIP INSPECTOR

The Oregon Association of Broadcasters (“OAB”) is seeking Proposals for an Inspector for its Alternative Broadcast Inspection Program (“ABIP”).  The following describes the OAB ABIP Program.  All Proposals must comply with the details of the Program as set forth below.

OAB is an Equal Opportunity Employer and encourages Proposals from women and minorities.

Proposals should be submitted to:  Bill Johnstone, President & CEO, Oregon Association of Broadcasters, 7150 S.W. Hampton Street, Suite 240, Portland, OR 97223-8366 by fax at (503) 443-2488 or by e-mail at theoab@theoab.org.

OAB has entered into an agreement with the Federal Communications Commission (“FCC”) whereby OAB conducts an Alternative Broadcast Inspection Program for broadcast stations located in the state of Oregon by independent broadcast engineers who are qualified and knowledgeable with the FCC's operating rules, regulations and policies.

The Inspector will work as an independent contractor and is not an employee of OAB.  OAB will submit the name of any applicant for this position to the local office of the Federal Communications Commission for its approval.  Respondents are not to contact the FCC’s local office directly.

The Inspector must be qualified to inspect both radio and television stations, including digital radio and digital television stations.  The scope of the inspection includes all technical aspects of the operation of a broadcast station as addressed by a regular FCC field inspection, including the public inspection file.  Inspections conducted by the Inspector must be consistent with the same standards used by FCC Field Inspectors in the conduct of normal field inspections.  Such inspections shall be conducted during normal business hours unless other arrangements are made between the OAB, the Inspector and the station being inspected.

The Inspector must be experienced and skilled in the inspection, maintenance, testing, adjusting and repairing of all transmitting equipment in Standard, FM and Television stations; know the Rules and Regulations of the FCC and keep abreast of all changes to the Rules respecting station operation; is particularly familiar with the regulations of the FCC relating to the inspection, maintenance, operation, testing, adjusting and repairing of transmitting equipment and the operating and maintenance logging requirements of the Commission, including the Emergency Alert System.  Membership in the Society of Broadcast Engineers is a plus; SBE certification is a plus, particularly the CPBE (“Certified Professional Broadcast Engineer”) designation.

The Inspector shall have available to him/her whatever mode of transportation and equipment that may be necessary to conduct the contemplated inspections at the various locations to be inspected in a professional and expeditious manner. This requirement is not intended to prevent the Inspector from utilizing any mode of transportation or equipment provided by the station(s) to be inspected so long as the Inspector, in the case of measurement equipment, is reasonably satisfied with the condition and accuracy of such equipment.

Within three weeks after each station inspection, Inspector shall provide the inspected station(s) a formal written report setting forth the results of the inspection, including specific citation to all deficiencies, with a copy of the Report provided to OAB.

If the station is found to be in compliance with applicable FCC rules and policies, the Inspector will notify OAB to issue a Certificate of Compliance for the Inspector’s signature.  If the station is found not to be in compliance, the Inspector will follow-up with the station chief operator periodically to determine whether the remedial actions required by the Inspector to bring the station into compliance have been met.  If a follow-up inspection is required due to the failure of a station to pass the inspection, an amended report shall be rendered to the station and the OAB upon successful completion of the follow-up inspection.  A follow-up inspection will be treated as a separate and new inspection for purposes of the Inspector’s fees and costs reimbursement.

Inspection fees and expenses will be billed to OAB by Inspector upon completion of each station or station group inspection. The invoice shall include and itemization of services, together with supporting receipts or other appropriate documentation for expenses incurred by Inspector.  Payment will be made by OAB to Inspector within thirty (30) days of receipt of the invoice rendered, provided the Inspection Report has been received by the station inspected and OAB.

The ABIP requires that the relationship between the Inspector and the stations being inspected must be done on an independent and impartial manner, thus precluding past or present contractual business relationship between the Inspector and the station being inspected which may give rise to the appearance of bias or a conflict or interest.  Inspector must disclose any such relationships to OAB, and will refrain from undertaking the inspection of any station where such contractual relationship exists or has existed within the preceding six (6) months.  The Inspector shall not, for a period of six (6) months following the completion of an inspection, accept any employment or provide any professional services to any broadcast station which Inspector has inspected.

The Inspector shall be responsible for maintaining a current business license and insurance policy providing comprehensive personal liability for himself/herself and any employees he/she may use while providing the inspection services. A certificate verifying such insurance coverage shall be provided to OAB prior to commencing any inspections.  OAB will not provide industrial insurance coverage.
